The Netherlands ∙ Country Report the Netherlands: to Notify, or Not to Notify?

The Netherlands Food and Consumer Product Safety Authority (‘NVWA’) has simplified its unsafe food notification guidance document per 19 January 2024. It aims to help FBOs even better than the previous version of the guidance to determine when to notify NVWA. However, in practice the first criticism is that the threshold for notification is now much lower, which would increase the burden on FBOs by having to notify (and manage the communication with) the supervisor much more often. Some even report that the notification instruction would be in breach with the applicable provisions of EU-law regarding responsibilities of FBOs.
