The Czech Constitutional Court Upholds the Illegal Practice of Marketing Food Supplements Containing Health Claims Prohibited by EU Law



A Czech consumer protection organization Unicampus, o.s. (the “Plaintiff”) applied for an interim measure before the first instance court consisting in prohibiting the distribution of a food supplement, BETA KAROTEN 25 000 I.U., produced by Aminostar s.r.o. (the “Defendant”). The package of the vitamin concerned bears a health claim that is prohibited by Regulation (EC) No. 1924/2006 of the European Parliament and the Council of 20 December 2006, on nutrition and health claims made on foods (the “Regulation”.)
