Czech Republic: The Unenforceability of Prohibited Health Claims Regulations before Czech Courts Revisited



On 13 December 2013 the District Court in Mladá Boleslav passed a judgment (File No. 11 C 98/2013?242) concerning prohibited health claims on the packages of a food supplement which raises a few interesting points of law. As to the facts of the case, a consumer protection organization, Unicampus, o.s. (hereinafter referred to as “Plaintiff”) asked the court to order the producer of the food supplement concerned, Aminostar, s.r.o., (hereinafter referred to as “Defendant”) to stop marketing its products bearing prohibited health claims after the date stipulated inthe applicableCommission Regulation No. 432/2012 (i.e. 14 December 2012) (hereinafter referred to as “Regulation”).
