As a futuristic industrial concept, the biotechnology industry tends to be used as a tool for commercialization by its producer since biotechnology is indeed a money-making tool. It is true that biotechnology has given abundant support in our daily life, taken into account the variation of its use. However, the negative impact is still imminent if it is not restricted by firm rules. This legal-normative research seeks the development of the biotechnology industry in Indonesia, especially in the food sector. Further, reckoning that the biotechnology industry is dominated by multinational companies, the research explores the potential for unfair competition to emerge. Biotechnology products are mostly protected by patent right, which allows some members of greater access to the products while others cannot afford to use them. The most evident example is seeds, which is indeed the seed of unfair competition.
