A Journey through the Colourful World of Health Claims Made on Food Stopping at Luxembourg and Karlsruhe

Regulation (EC) No. 1924/2006 on nutrition and health claims made on food has now been in effect for seven years and has been the subject of several court decisions. These cases fill this complex and much discussed piece of EU legislation with life and shed light into the darkness. However, the individual case law also shifts the interpretation of the Health Claims Regulation in a non-preferable direction, and careful attention must be paid to the correct interpretation of these decisions. The aim of this article is not only to present but to guide you through recent judgments on health claims by the European Court of Justice located in Luxembourg and the German Federal Court of Justice based in Karlsruhe. On today’s menu is the fruit quark “Monsterbacke”, which keeps the German Federal Court of Justice busy after the European Court of Justice’s decision in April. The ECJ case “Green Swan” and the German case “Vitalpilze” contribute food supplements to today’s bill of fare. The German FCJ decision on the product name for baby food “Praebiotik®+Probiotik®” will be the main course followed by the children’s product “Lernstark” as a little dessert.
