Assessing the Czech Republic´s EU Presidency with Respect to Food Related Consumer Protection Journal Artikel Nicole Grmelová, Petr Tomčiak European Food and Feed Law Review, Jahrgang 18 (2023), Ausgabe 2, Seite 63 - 69 Between 1 July 2022 and 31 December 2022 the Czech Republic held its second presidency of the Council of the EU in its history. Whereas the overall assessment of the EU Presidency is generally positive, not all the food related issues of consumer protection were addressed with due diligence and will need to be renegotiated at EU level in the course of 2023. This paper will address both, the achievements of the Czech EU Presidency, in particular the agricultural subsidies and fishing quota agreement, as well as its setbacks with respect to reducing the plant protection products in food production and the front of package labelling of foodstuffs, where Nutri-Score failed to be adopted as the general mandatory labelling standard across the EU.

The Unfair Trading Practices Directive Revisited Journal Artikel Nicole Grmelová European Food and Feed Law Review, Jahrgang 17 (2022), Ausgabe 4, Seite 300 - 305 The Czech Republic has missed the transposition deadline for implementing the EU Unfair Trading Practices Directive in business-to-business relationships in the agricultural and food supply chain. Yet, business relationships between a buyer (the Hruška retailer) and several suppliers of food products have already witnessed breaches of that Directive. These had to be assessed by the Czech Competition Authority also under the applicable Czech legislation, which is the Significant Market Power Act. The paper concludes that the Czech Competition Authority conducted a legal assessment of the case in compliance with the EU Directive. Also, this contribution summarizes the current stage of progress towards achieving full transposition of the EU Unfair Trading Practices Directive into the Czech domestic legal order by way of amending the current Significant Market Power Act. Completing the transposition of the Directive as soon as possible is essential in order to stop the infringement procedure lodged by the European Commission against the Czech Republic in this respect.
