The peculiar situation created by the co-existence of the Italian legislation on food supplements and the Community legislation on nutrition and health claims, when applied in Italy to food supplements characterised by the presence of plants or plants extracts, is continuing to provoke controversy between the Community institutions. In this article we join those scholars who have already advocated the legality of the Italian draft legislation.
