REFIT of Food Legislation: An Opportunity to Discuss Implementation and Enforcement Issues

The current REFIT of Regulation 178/2002 (General Food Law Regulation) initiated by the European Commission aims at assessing whether Regulation 178/2002 is fit for its purpose and identifying its burdens, inconsistencies and ineffective measures. In this article, we discuss the direction that the European Commission might consider taking, in view of increasing the legal certainty of the operators and avoiding over-reaching and inconsistent enforcement with respect to basic elements of Regulation 178/2002, such as the general safety requirement, withdrawals, responsibility of food operators and EFSA’s transparency. At the second stage of the REFIT, the Commission will focus on secondary food legislation. Health claims and novel food legislations are taken as examples of secondary legislation that might not be fit for their purpose.
